INSURANCE DISCLAIMER

Sever Gallery does not maintain Inland Marine or fine art transit insurance unless expressly stated in writing for a specific transaction.

Accordingly, Sever Gallery shall not be held liable for loss, theft, or damage to artwork occurring during transit, exhibition, storage, or handling by third parties unless such loss is directly caused by Sever Gallery's proven gross negligence or willful misconduct.

Important: Insurance coverage is the responsibility of the customer unless otherwise explicitly stated in your purchase agreement.

INSURANCE RESPONSIBILITY

Collectors, buyers, shipping carriers, exhibition venues, and partner galleries are solely responsible for maintaining adequate insurance coverage for artwork while it is in their possession, custody, or control.

AGREED VALUE DISCLAIMER

Any stated artwork value is for sales and reference purposes only and does not constitute an agreement or obligation by Sever Gallery to insure the artwork at that value.

EXHIBITIONS AND CERTIFICATES OF INSURANCE

For exhibitions, loans, or consignments with third-party galleries, institutions, or venues:

  • Sever Gallery requires a valid Certificate of Insurance (COI)
  • The COI must name Sever Gallery as an Additional Insured
  • Coverage must remain in effect for the full duration of possession

Failure to provide a compliant COI may result in cancellation or refusal of the exhibition or loan.

PRODUCT LIABILITY

Sever Gallery maintains Product Liability insurance to protect against claims arising from:

  • Bodily injury
  • Property damage
  • Accidents involving artworks (e.g., installation failure, falling sculptures)

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Sever Gallery's liability shall be limited to the purchase price of the artwork
  • Sever Gallery shall not be liable for indirect, incidental, consequential, or punitive damages

GOVERNING LAW

This Policy shall be governed by and construed in accordance with the laws of the jurisdiction in which Sever Gallery is registered, without regard to conflict-of-law principles.

By purchasing from or engaging with Sever Gallery, you acknowledge and agree to this Policy.
